A. No, there is no limit. A lot of landlord are asking for larger deposits because tenants either leave without paying or they cause far more damage than a single months security would cover.

A. Considering that the tenant gets nothing tangible until they can move in, and that the board's decision is totally out of their control, and at least arguably in your control (you could probably persuade them to deny approval if you wanted to), the initial deposit is refundable if the board turns them down. On the other hand, you're trying to protect yourself from taking the apartment off the market until they meet and decide, and then finding out he doesn't really want it anyway, so you do need something in case that happens. If you think $1,000 protects you from him walking away after being approved, and he agrees, it's fine. Just be sure you stick to the deposit you want once it is available to the tenant, before they move in.

How do I recover a security deposit that was sent to my roommate?
Q. I wrote the check for the security deposit. Our management company negligently sent it to my roommate. I am owed at least half, I am hoping for more. My roommate left without cleaning and with some of my belongings. We don't speak, and I found out she already cashed the check. Do I take her to small claims court, the management company, or both? A. As much as I'd like to help you (tenant defense is my forte), you are in the wrong here, I apologize. You have rights guaranteed to you by the landlord tenant statutes in your unknown state. They protect you from retaliatory rent increases, but this sounds either like your renewal or you are a month to month tenant. If this was in the middle of a lease contract and she (out of the blue) increased your rent, that is against the law. However, telling you that this WILL be the new rent once you renew, that is fine. A. They are not supposed to ask for it after you moved in. BUT- that said, you already agreed to it. It is too late to protest now. If it is stated on the new lease YOU signed, then you must pay or they will have legal grounds to evict you. How were you under distress to sign? Landlords are notorious for bullying their tenants, and most tactics they use are illegal. But the tenants do not know that so they cave.

A. Your lease should spell out the time frame for returning your deposit. Most leases don't allow for the termination of the lease for something as voluntary as the want of a pet. I'm surprised the landlord has agreed to return your money at all. That said, if he has agreed to do so and doesn't comply with the time frames defined by the lease you would have to go to small claims court to recover your money.

A. They're required to send you a itemized list of the damages that make up your deposit, OR return the deposit (full/partial) within 10-14 days depending on your state. Look up the landlord tenant laws and cite the law as it applies and ask for the list if he claims it used it up. After that it would be up to you to sue and prove that the damages he listed where not your fault...but this can be hard unless you have pictures!

A. Not likely. Pet deposits are usually a separate fee that you pay in addition to your security deposit. It's usually PER PET. There's also (sometimes) an additional pet fee added to the rent every month. Just about every apartment complex I've looked at in my area does this. It's spelled out very clearly in my current lease. I have birds, which most places don't require a pet deposit and fee for.

A. Normally, you want to make sure that minor repairs that you'd be responsible for are made (like, if you put small holes in the wall). Normal wear and tear is allowed, but if you wrecked something that has to be fixed, it'll come out of the deposit. Also, you must clean the apartment - if you dont, he can hire a service and take it out of the deposit. If you think he'll try to keep it, take video of the apartment before you lock up, so that you can verify the state of the apartment. As to the mold formation - did you notify him it was leaking and request it be fixed?

A. it varies by area but I would try $1,000. about 1-2% of purchase price. Note even your own realtor will ask for more because they want you on the hook. they do not get paid until the deal closes. the more you put down the more likely you are to close. But most sellers will never counter offer an earnest deposit. They will accept whatever you put down. If your realtor tells you more insist on $1,000.

When you move out, the landlord must either return your deposit within 15 days of termination of the rental agreement, if the landlord does not intend to impose a claim upon the security deposit; or justify in writing by certified mail, to the tenant's last known mailing address within 30-days upon termination of a rental agreement, as to why they are keeping a portion of or all of the deposit.
